Abstract:Chinese rule of law is the embodiment of Chinese rule of law subjectivity, which comes from the practice of the socialist rule of law with Chinese characteristics and is an era expression of the traditional excellent legal culture in the legal system with Chinese characteristics. Chinese legal culture is realizing the transformation from legal orientalism to oriental legalism, showing the self-confidence of the legal culture of the times and the consciousness of legal theory. The Chinese-style rule of law interprets its personality traits through the connotation of emotion, reason and law, and shapes its distinctive “Chinese” characteristics. This connotation of emotion, reason and law is rooted in Chinese rural society and originated from traditional Chinese etiquette and law culture. Through the collaborative governance model of heavenly principles, national laws and human feelings, as well as the structural layout and functions of “upholding heaven and earth”, the value of Chinese-style rule of law has been achieved. The relationship between the “law of heaven” and the “law of rites”, the relationship between the “law of rites” and the “law of emotions” constitutes the connotation structure of the Chinese rule of law. In the context of the modernization of the Chinese rule of law, it is necessary to achieve the creative transformation and innovative development of the traditional Chinese rule of law through the relationship reconstruction and value reshaping of the law of reason and emotion, and to achieve its modern function through alternative dispute resolution, governance of the source of litigation and collaborative governance and other practical mechanisms.
