Abstract：Although the International Criminal Court was established only a short time ago，it is important to international criminal trials, and particularly in human rights security. The cases to which the International Criminal Court applied Convention on the Prevention and Punishment of the Crime of Genocide indicate the law has been exerting its positive function in protecting human rights such as ruling serious violations of human rights, enforcing interim measures, and promoting world peace. In application, however, the law faces a lot of challenges: its jurisdiction is questioned; the international criminal courts are not yet very common; impunity still exists. In this case, the author suggests that measures should be taken to improve the current situation. Firstly, we should define jurisdiction of the International Criminal Court. Secondly, we should expand the applicable scope of the crime of genocide. Third, we should strengthen the execution of the International Criminal Court.
