Blockchain Enabling Data Asset Securitization and Its Legal Governance |

Abstract Data asset securitization is a financial innovation tool that effectively combines data assets and securities financing, which helps activate the potential of data elements and promote data asset value mining. At present, China has the initial foundation to explore the combination of “data + capital”, and key technologies such as artificial intelligence, big data, cloud computing and blockchain provide technical support to promote securities innovation. It is essentially a digital reconfiguration of the securitization process of data assets by blockchain. However, as a new technology, while blockchain has an enabling effect, there are three potential risks, including the legal risk caused by the existing system lagging behind the technology-enabled practice, the technical risk caused by the limitations and improper application of blockchain, and the regulatory risk caused by the difficulty of adapting the existing regulatory model to fintech innovation. In this regard, it is necessary to try to systematically build a legal governance framework based on the integration of innovation and risk prevention, and to provide institutional and practical references for revitalizing the value of data assets and promoting securitization of data assets by improving the legal system, clarifying behavioral norms and strengthening financial supervision.
