Abstract:Different from other cultural conventions, the Convention on the Protection of Intangible Cultural Heritage explicitly stipulates only intangible cultural heritages that conform to existing international human rights documents are eligible for protection. Subjectively, the introduction of human rights into the protection of intangible cultural heritage is intended to offset the negative effects of cultural diversity and promote the protection of intangible cultural heritage by means of human rights law. Objectively, it is related to the UN's efforts in promoting the full implementation of the international human rights framework in the form of treaties. In the past decade, the human right elements in the review of intangible cultural heritage list display dual functions. One is to be used as criteria to judge whether a heritage project is eligible for protection on global scale. The other is to promote the development of cultural rights, especially the right to be recognized and treated as cultural heritages. The protection of intangible cultural heritage and the protection of human rights benefit each other in interaction, and cultural rights become a powerful carrier to communicate universal human rights and diverse culture. Due to lack of explicit regulations regarding the conflicts between cultural rights and other human rights in the Convention on the Protection of Intangible Cultural Heritage, the new “dialogue mechanism” in the review of intangible cultural heritage list provides institutional guarantee for resolving these conflicts. Human rights are expected to be explicitly reflected in its future implementation, so as to better promote the positive interaction between intangible cultural heritage protection and human right protection.
