Abstract:The legal view of Wei-Jin metaphysics originated during the transformation from the study of Confucian classics to divination studies in Han Dynasty, when criticism and reflection on Confucianism emerged as a trend. Its direct theoretical origin was the idea of ontology. It was mainly embodied in the arguments on “non-being” and “being”, on the relationship between language and meaning, and on the relationship between social norms and human nature. It was a great theoretical achievement of legal philosophy in ancient times, greatly promoting the development of Chinese traditional jurisprudence. Its values were mainly characterized by the unity of opposites between freedom and order, and elevation from metaphysical ontology to advocacy of “rule of man”.
