| The Historical Evolution of the Value of Due Process of Law——on the Common Law of Anglo-American States |

Abstract The due process of American constitution originated from the tradition of English common law. Although early due process was more procedural rules than substantial ones, it had developed into substantial procedure in American legal system after the philosophical reform of natural rights. Both the substantive due process and the procedural due process are intrinsically related to natural rights. The early association existed as a fact which is limited strictly by traditional natural law. And the subsequent substantive due process indicates that the judges were well aware of this intrinsic relationship, consciously applied the principles of natural rights to the innovation of traditional procedure, which further developed and enriched the content of due process of law. The evolution from procedural connotation to substantive connotation of due process of law is the result of gradual combination of process of common law and the idea of natural right.
