Abstract：Judges’ humanity is a spiritual mixture of animality and sociality. Contradictory as they are to each other, animality and sociality are unity of opposites. The irrational desire for survival results in violation of obligatory rules and judicial injustice in the performance of their duties, which is judges’ evil nature. Judges’ good nature is embodied by their sociality, which results in judicial justice in the performance of their duties. The basis for the regulation of judges’ humanity is to ensure that they enjoy adequate material and rest. Equipping judges with professional knowledge, reducing temptation, and increasing deterrence of criminal legislation are effective means to encourage judges to exhibit good nature when performing their duties.
